So...will this be an in for police to obtain blood samples? ie-they can draw someones blood under so called suspicion of driving while high,to 'test' it?Will they then destroy any record,or legally or illegally keep that DNA recorded?I'm concerned this may start taking place in Canada and the USA.Do some places now take blood samples for alcohol? I don't drive,so I really don't have idea about the process. As far as I know, right now in Ontario and Quebec it's just a breathalizer. Oh,and someone gifted me a nice chunk of Lebanese blonde hash today! In the States one generally needs to voluntarily submit to a blood draw or it's inadmissible in court. If a blood draw is believed to be necessary, the police must obtain a warrant for such based on the behavior or belief the impairment of the individual warrants a blood test. I don't know how the DNA thing works in these scenarios. Congrats on the hash.

You have to have a positive breath test first though.
I believe the law states - in both our countries - DNA cannot be retained unless it was voluntarily submitted for the purpose of DNA testing. If one is then eliminated, or found not guilty, it must be destroyed. If it were retained outside of this, it couldn't be used in court.

I wonder if they are going to try and make it so you have to provide blood for a pot test.
